The Federal Transit Administration (FTA) Seeks Public Comment on Changes to Third-Party Contracting Guidance

FTA has published a Federal Register notice seeking public comment on proposed updates to its Third-Party Contracting Guidance.
The proposed guidance, available in the form of an updated circular, pertains to procurements financed in whole or part with Federal assistance awarded by FTA through grants or cooperative agreements (i.e., “third-party” procurements). This updated circular would replace Circular FTA C 4220.1F, last revised on March 18, 2013.
The proposed updates reflect statutory and regulatory changes since the last update and provide additional non-binding guidance, including:
• Clarifying how the circular applies to different entities, including states, tribes, non-state recipients, and third-party contractors, while updating guidance on recipient responsibilities.
• Addressing data collection, ownership, and usage considerations as contracts increasingly involve data-related components.

Comments must be submitted using the Federal eRulemaking Portal at www.regulations.gov→, under docket number FTA-2024—0015. The deadline to submit comments is December 27, 2024.
